Minor amendments for Local Environmental Plan and draft Development Control Plan

Council Approval and Publishing

On 10 August 2015, Council approved the Minor Policy and Housekeeping Amendments to the Sydney Local Environmental Plan 2012 and Sydney Development Control Plan 2012.

On 6 May 2016, the amendment was incorporated into the Sydney Local Environment Plan 2012 being published on the NSW Legislation webpage. The amendment to the Sydney Development Control Plan 2012 came into force simultaneously with publication of the Sydney Local Environmental Plan 2012.

Description of Amendment and Exhibition Period

The City of Sydney invited submissions for proposed changes to Sydney Local Environmental Plan 2012 (Sydney LEP 2012) and Sydney Development Control Plan 2012 (draft DCP amendment).

The proposed changes will make both plans clearer and more user-friendly and ensure the intended planning outcomes can be achieved. The changes will:
  • encourage more low-impact creative uses in the R1 General Residential zone
  • help activate more laneways in the city centre
  • remove barriers for car share parking spaces across the local area
  • encourage more community and childcare facilities in the city centre
  • clarify community infrastructure requirements for Green Square
  • permit a wider range of businesses in the medium density residential estate at 83– 93 Dalmeny Avenue, Rosebery.
Other changes include amendments for balconies on residential towers and apartments with setback bedrooms, as well as floor to ceiling heights in non-residential developments. They also include updates to the heritage schedule for several properties.

The proposed amendments were on public exhibition until Tuesday 7 April 2015. Exhibition period has closed and the City will consider all submissions received and will report the outcomes of the exhibition to Council and the Central Sydney Planning Committee.

If Council approves this planning proposal after public exhibition, it can amend the Sydney Local Environmental Plan 2012 on behalf of the Minister for Planning.
